Instructions for use

These instructions for use (hereinafter, the "Terms of Use") regulate the terms and conditions of use for users to acquire/download/use the VIRTUO Cards.

 

Consequently, these Terms of Use regulate the relationship between the user and CHEQUE MOTIVA S.L. (hereinafter, CHEQUE MOTIVA), a company with registered office at Calle Alcalá 106, 1st floor, Madrid and CIF B-84391929, in relation to the acquisition, download and use of VIRTUO Cards.

 

By registering on XXXXXXXXXXXXXXXXX (hereinafter, the Website) and entering the locator code and registration data necessary to obtain the VIRTUO Card, you declare that you are aware of these Terms of Use, accept them and consent to be bound by them. Consequently, if you do not agree with the full content of these Terms of Use, you should not register on the Website to purchase the VIRTUO Card.

 

 What are VIRTUO Cards?

 

The VIRTUO Cards allow users to make purchases/payments for products and/or services in any e-commerce and/or physical establishment (hereinafter, both, indistinctly, will be referred to as the "merchant"), until their balance is exhausted.

 

Who and how can I purchase VIRTUO Cards?

 

The user who has obtained a locator code (Virtuo Card code) may, after a registration process on the Website, be the holder of a VIRTUO Card with a set balance.

 

To be a holder of the VIRTUO Card, you must complete the process and registration available on the Website as follows:

 

1.        The user accesses the Website and must enter the Virtuo Card code, which will correspond to a VIRTUO Card with a set balance.

2.        After verifying that the Virtuo Card code is correct or not expired, the registration form must be completed by entering the requested data, such as name, surname, NIF, date of birth, telephone number and email. The email address will need to be confirmed.

3.        If the format of the data in the form is correct, the user will receive an SMS on the indicated mobile phone with a verification code that must be entered on the website.

4.        Once the verification code has been validated, the user will access the data of the VIRTUO Card; numbering, CVV, expiry date and balance.

At that time, the user will be able to download the VIRTUO Card in PDF format or copy the number of the VIRTUO Card and link it to the Google Pay or Apple Pay applications, for which a small help manual is provided on the Web.

 

For subsequent accesses and queries of balances and movements, the user must re-enter the initial locator along with the telephone number provided and confirmed in the registration form in order to verify that the user is the correct one.

 

The user declares that he/she is of legal age and has the necessary legal capacity to contract the services offered on the Website, in accordance with these Rules of Use of VIRTUO Cards, which he/she declares to understand and accept.

 

The user is solely responsible for the veracity and accuracy of the data provided in the registration process.

 

TERMS OF USE

 

-            In the event of theft, theft or loss of the VIRTUO Card, Cheque Motiva is exempt from all liability, and no amount will be refunded.

 

-            The use of the VIRTUO Card will be limited to the balance available at the time of use. The user must ensure that they do not make purchases for an amount greater than the current balance at any given time, as the transaction will be denied. The possibility of completing the remaining price in the event of a transaction for an amount greater than the balance of the VIRTUO Card will be at the sole discretion of the merchant in which the purchase of goods or services is being made.

 

-            The validity period or expiry date of the VIRTUO Card will be stated on the VIRTUO Card.

 

-            If the user has not fully or partially consumed the balance incorporated into the VIRTUO Card within the period of validity established in the VIRTUO Card itself, this will not entitle the user to request the return or refund of the unused balance. Therefore, the expiry of the VIRTUO Card entails the loss of the unused balance and the inoperability of said card.

 

-            Purchases are transactions that take place between the merchant and the User. Under no circumstances will CHEQUE MOTIVA be held responsible for any incidents that may arise between the business and the user on the occasion of a specific purchase or acquisition of products and/or services.

 

-            Once the balance of the VIRTUO Card has been consumed, it will be inoperative.

 

-            Each time the VIRTUO Card is used, it will be understood that the user's authorization is granted when they make a certain transaction and make the payment through the appropriate POS terminal or confirm the purchase on the merchant's website. From that moment on, the user will not be able to revoke the payment transaction, expressly authorizing the charge to the VIRTUO Card, including any applicable taxes, and subtracting these amounts from the balance on the VIRTUO Card. It is the sole responsibility of the user to diligently safeguard their VIRTUO Card to make the payment of purchases, avoiding access by third parties to it. Therefore, all transactions carried out will be understood to be authorised by the user himself and may not be revoked, without prejudice to the rights that the user may have vis-à-vis the business.

 

-            After the purchase transaction, if the user wishes to obtain the corresponding invoice for said transaction, he must request it at the store where he has made a certain purchase or acquisition.

 

-            VIRTUO Cards may not be exchanged for cash or traded. The user undertakes not to use the VIRTUO Card in an illegal manner and contrary to these Terms of Use.

 

-            CHEQUE MOTIVA shall not be liable to users or to third parties for any possible direct or indirect damages that may be suffered as a result of fraudulent use of the VIRTUO Card by the user or by unauthorised third parties.

 

-            Nor is CHEQUE MOTIVA responsible for any defects or hidden defects that may be present in the VIRTUO Cards and that are attributable to the company issuing or distributing them.

 

-            The images and texts on the Website are not and do not constitute contractual offers.

 

CUSTOMER SUPPORT

Users are guaranteed that when they use the VIRTUO Card to pay for a certain purchase under the terms required by the merchant, it will be accepted as a payment method. However, CHEQUE MOTIVA does not assume any obligation or guarantee with respect to the provision of the services(s) or acquisition of the goods/s or product(s) by the business, the fulfilment of which corresponds exclusively to the business as the independent entrepreneur that it is, and CHEQUE MOTIVA is exempt from any non-compliance, whether total or partial, as well as from the defective fulfilment of said provision and/or acquisition of products.

 

However, when CHEQUE MOTIVA has been informed by the user of any type of anomaly or deficiency in the use of the VIRTUO Card, it will make its best efforts to find a prompt solution to the anomaly or deficiency reported by the user.

 

Claims that do not conform to these Terms of Use will not be considered.

 

DATA PROTECTION

 

The processing of the Personal Data that the user has provided in the registration form on the Website to CHEQUE MOTVA for the application and obtaining of the VIRTUO Card and any other data that the user may provide to it related to the content of these Terms of Use, will be carried out in accordance with the provisions of the Privacy Policy of the Website that can be consulted at

APPLICABLE LAW AND JURISDICTION

 

These Terms of Use are subject to Spanish Law and to the exclusive jurisdiction of the Courts of the City of Madrid.
